NADD Pay Terms of Use.

These Terms of Use govern access to and use of NADD Pay on WhatsApp, including sending, receiving, withdrawing, converting, and interacting with NADD through supported NADD services.

Rules governing use of NADD Pay.

Users must use NADD Pay responsibly, lawfully, and only through official NADD access channels.

1. Acceptance of These Terms

By using NADD Pay on WhatsApp or any related NADD service, you agree to be bound by these Terms of Use. If you do not agree, you should not use NADD Pay.

2. About NADD Pay

NADD Pay is a WhatsApp-native access layer for NADD, enabling users to send, receive, transact, withdraw, and access supported NADD services through WhatsApp.

3. Nature of NADD

NADD is a privately issued digital payment instrument. It is not legal tender, not a CBDC, and not issued, guaranteed, or endorsed by the Bank of Namibia or any central bank.

4. User Eligibility

Users must be legally capable of using digital payment services in their jurisdiction and must comply with all applicable laws, rules, and regulations.

5. User Responsibilities

Users are responsible for safeguarding their WhatsApp account, mobile device, PINs, credentials, wallet addresses, and any external wallet used with NADD Pay.

Users are responsible for verifying transaction details before confirming any transfer, withdrawal, conversion, or wallet address submission.

6. Transactions

NADD Pay may allow users to send, receive, withdraw, and convert NADD through supported transaction flows. Transactions may be irreversible once processed or recorded on blockchain networks.

NADD Pay is not responsible for losses caused by incorrect wallet addresses, user error, unauthorized device access, compromised WhatsApp accounts, or unsupported external wallets.

7. NADD to USDT Conversion

Where supported, users may convert NADD to USDT through NADD Pay. Conversion availability may depend on liquidity, system availability, treasury controls, applicable limits, risk checks, and operational readiness.

8. Withdrawals and External Wallets

Users may withdraw supported assets to compatible external wallets where available. Users must ensure that external wallet addresses are compatible with the applicable network, including BNB Smart Chain where relevant.

NADD Pay is not responsible for assets sent to incompatible, incorrect, inaccessible, or unsupported wallet addresses.

9. Off-Ramp and Third-Party Services

Any conversion from digital assets into fiat currency through exchanges, wallet providers, payment processors, banking partners, or other off-ramp services is subject to the terms, fees, limits, compliance requirements, and availability of those third-party providers.

10. Fees, Limits, and Availability

NADD Pay may apply transaction fees, withdrawal fees, conversion fees, limits, cooldown periods, risk controls, and other operational rules. These may change from time to time based on system requirements, liquidity, compliance, or operational risk.

11. Prohibited Use

Users may not use NADD Pay for unlawful, fraudulent, abusive, sanctioned, deceptive, or unauthorized activity. NADD Pay may suspend, restrict, or block access where misuse, fraud, security risk, or compliance concern is detected.

12. Compliance and Monitoring

NADD Pay may monitor transactions, maintain audit logs, apply risk controls, request additional information, and cooperate with competent authorities where required by applicable law or internal compliance procedures.

13. Service Changes and Suspension

NADD Pay may modify, suspend, restrict, or discontinue any feature, transaction flow, wallet function, conversion service, or access channel at any time for operational, technical, legal, compliance, security, or business reasons.

14. No Financial Advice

Information provided through NADD Pay or official NADD channels is for operational and informational purposes only and does not constitute financial, investment, legal, tax, or banking advice.

15. Technology and Blockchain Risks

Users acknowledge that blockchain networks, smart contracts, wallets, exchanges, APIs, hosting providers, telecommunications networks, and third-party platforms may experience delays, outages, errors, attacks, congestion, or other technical failures.

16. WhatsApp and Third-Party Platforms

NADD Pay operates through WhatsApp and may rely on services provided by Meta Platforms, Inc. Use of WhatsApp remains subject to Meta and WhatsApp terms, privacy policies, platform rules, and availability.

17. Limitation of Liability

To the maximum extent permitted by law, NADD, NADD Pay, NADD Labs, and their affiliates, officers, employees, service providers, or representatives shall not be liable for indirect, incidental, consequential, punitive, special, or loss-of-profit damages arising from use of NADD Pay.

18. Disclaimer of Warranties

NADD Pay is provided on an “as is” and “as available” basis. No warranty is given that the service will be uninterrupted, error-free, fully secure, or available at all times.

19. Updates to These Terms

NADD Pay may update these Terms of Use from time to time. Updated versions will be published through official NADD channels. Continued use of NADD Pay after updates are published may constitute acceptance of the updated terms.
